Lottery Tote Rules Moray Constituency Labour Party

  1. Introduction
    • The Moray Constituency Labour Party (“Moray CLP”) Lottery Tote will be operated as a Small Society Lottery under the Gambling Act 2005 as amended (“the Act”).
    • The Lottery Tote is promoted by the promoters and conducted for the benefit of Moray CLP.
    • The Lottery is administered by Moray CLP, 2, Linkwood Close, Elgin, Moray IV30 6BF.
    • These Rules apply to the promoters, playing members of the Lottery Tote, and Moray CLP.
  2. Definitions
    • “The Act” means the Gambling Act 2005.
    • “Lottery Tote” means the Small Society Lottery run by Moray Constituency Labour Party.
    • “Draw” means the process by which winners are selected.
    • “Member” means an individual who has registered with the Lottery Tote.
    • “Rules” mean the rules of the Lottery Tote as set out herein and amended from time to time.
    • “Entry” means individual entry into the Lottery Tote on behalf of a member.
    • “Moray CLP” means the organisational unit of the Labour Party responsible for promoting the aims and objectives of the Labour Party within the Moray Scottish Parliament Constituency.
    • “The National Lottery” has the same meaning as in the National Lottery etc. Act 1993.
    • “The promoters” means those persons delegated by Moray CLP to organise and promote the Lottery Tote.
  3. Entry into the Lottery Tote
    • The Lottery is promoted in accordance with the Gambling Act 2005 as amended (“the Act”). In order to comply with the Act, and to purchase entries a member will be required to confirm that:
      • They are at least 16 years of age.
      • They will not buy or claim to buy lottery entries on behalf of any other person.
      • If, upon winning any prize in the Lottery, a member is not able to prove that they have met the criteria specified in Rules 3.1.1 and 3.1.2 then they will not be entitled to receive that prize.
      • In order to comply with the Act entries that have been purchased and entered into the correct draw cannot be refunded.
    • By entering into the Lottery Tote members agree to be bound by these rules, and the applicable provisions of the Act and/or any relevant regulations made thereunder from time to time.
    • Neither the promoters and/or Moray CLP shall be liable for any loss or damage (including loss of the opportunity to enter the Lottery and/or the right to receive a prize) suffered by members if they have not complied with the rules.
    • The price of each entry into the draw is £5.
    • Each entry shall afford each entering member two attempts at winning the first and second prizes, as well as a single attempt at winning the bonus ball prize.
    • The maximum number of entries an individual will be permitted to purchase in any one draw is ten.
    • The rules may be amended by either the promoters and/or Moray CLP from time to time and any changes will be posted on Moray CLP’s website.
    • The promoters and/or Moray CLP will make reasonable efforts to communicate any changes to the rules to members. Such reasonable efforts shall include, in particular, an email sent to members.
  4. Registration with the Lottery
    • Members can only enter the Lottery Tote by the completion of a valid application form which may be published in a variety of forms from time to time.
    • A valid application is one which includes the following information:
      • The member’s name and address, so that we can write to the member to confirm their entry into the lottery and contact them if they have won a prize.
      • Standing order details.
    • The promoters and/or Moray CLP shall be entitled to take any steps necessary to verify the above information and to process any member’s registration. The promoters and/or Moray CLP may refuse to accept an application for an individual to become a member of the Lottery Tote.
    • A member shall be entered into the Lottery Tote in the first relevant National Lottery draw following that member’s first payment into the Lottery Tote fund.
    • It is the responsibility of members to ensure that the personal information provided to us is accurate and the promoters and/or Moray CLP cannot be held liable for any error.
  5. Payment
    • Payment for winning entries may be made by the following methods as more particularly set out in clause 4.4:
      • Cheque
      • BACS payment
      • Cash
      • Any other method made available from time to time.
  1. Changes to Member Details
    • Any changes to a member’s details should be notified to the promoters and/or Moray CLP in writing or by e-mail as soon as practicable. Changes to the bank or building society specified during registration may require the completion of a new standing order instruction.
    • Neither the promoters and/or Moray CLP can be held liable for any losses occasioned as a result of a member failing to comply with clause 6.1.
  2. Draws
    • The draw is based upon the numbers of the first weekend National Lottery draw of the relevant month.
    • The winners of the respective prizes shall be determined as follows:
      • The first prize shall be awarded to the entries that correctly selected the first two numbers drawn in the second weekend National Lottery draw of the relevant month in the order in which the numbers were selected.
      • The second prize shall be awarded to the entries that correctly selected the first two numbers drawn in the second weekend National Lottery draw of the relevant month in any order in which the numbers were selected but not if those entries correctly selected the first two numbers drawn in the Saturday National Lottery draw in the order in which the numbers were selected.
      • The bonus ball prize shall be awarded to the entries that correctly selected the bonus ball drawn in the Saturday National Lottery draw.
  1. Prizes
    • The prize fund shall be 80% of the unawarded receipts of the Lottery Tote, up to a maximum of £5,000. Where the unawarded receipts of the Lottery Tote exceed £5,000 any excess funds shall be paid directly to Moray CLP.
    • Prize-winners will be determined by whether an entry matches the criteria provided for under rule 7.2.
    • Each winner under rule 7.2 shall be entitled to an equal share of the prize as follows:
      • For the first prize, an equal share of 60% of the unawarded receipts;
      • For the second prize, an equal share of 20% of the unawarded receipts;
      • For the bonus ball prize, a fixed prize of £20.
    • Moray CLP reserves the right to amend the prizes at any time. Any such changes will be published on the Moray CLP website at least one month prior to a change being made.
    • The results of each draw will be published by email to the Lottery Tote members and may also be published in any other manner determined by Moray CLP from time to time.
    • Winners will be notified by email, or any other appropriate means, within one month of the date of the Draw.
    • The prize may be issued via a cheque, bank transfer, or cash to the value of the prize won made payable to the Member.
    • Moray CLP reserves the right to withhold the payment of any prize until it is entirely satisfied that the Member who has won the prize has fully complied with the Rules.
    • Any uncashed cheque prizes after a period of six months shall be deemed to be forfeited.
  2. Suspension of the Lottery
    • Moray CLP may (at its absolute discretion) suspend the Lottery Tote for any period of time.
  3. Liability
    • Moray CLP shall not be liable to any member for any loss or damage suffered by that member arising from:
      • Any delays or failures in the postal service or other delivery methods used by Moray CLP or members from time to time.
      • Any delays or failures in any systems used by the Moray CLP or you to transmit e-mails.
      • Any failure in any software or other systems used by the Moray CLP for the administration of the Lottery Tote.
      • Any delays of failures in the banking system used by Moray CLP or members.
      • Any refusal by Moray CLP to accept registration of an individual as a member or the cancellation of a Member by Moray CLP.
      • Any event beyond the reasonable control of Moray CLP.
    • Moray CLP shall not be liable to any member in contract, delict, negligence or otherwise for any indirect or consequential loss suffered by that member in relation to their participation in the Lottery (including loss of the opportunity to enter the Lottery and/or the chance of winning a prize).
  4. Complaints
    • Any complaints relating to the Lottery should be sent in writing to Moray CLP, giving full details of the complaint and supporting documentation.
    • Save as provided for in this Agreement, the promoters and/or Moray CLP shall make the final decision on the complaint pursuant to the Rules and that decision shall be final and binding.
    • Save where the Rules expressly provide otherwise, the promoters and/or Moray CLP shall not be obliged to enter into any correspondence.
  5. Privacy
    • Data collected from members is used lawfully in accordance with the General Data Protection Regulation 2018 and is used solely for the purpose of processing your purchase of the Lottery Tote, subsequent entry into the Lottery Tote, and informing members if they have won a prize. The Labour Party is the data controller and Moray CLP is the data processor of any personal data.
    • Members have the right to make a subject access request under the General Data Protection Regulation 2018 to access the information the promoters and/or Moray CLP. To obtain this information, please contact Moray CLP in writing.
    • Neither the promoters and/or Moray CLP will sell, rent or grant access to any of the personal data we collect about members to any third parties.
    • Either the promoters and/or Moray CLP may be obliged to disclose members’ personal information if required to do so by law, for example to statutory bodies such as the Gambling Commission or other government bodies.
